Quick Summary
Every waste processing or disposal facility a local body runs itself — compost, biomethanation, RDF or waste-to-energy plant, or sanitary landfill — needs an authorisation from the State Pollution Control Board. The local body applies in Form I; the Board issues Form II. The authorisation lasts as long as the plant's consent, and renewal is applied for at least 60 days before it expires.
What This Rule Is
Solid Waste Management Rules, 2026 (S.O. 388(E), 27 January 2026, in force 1 April 2026):
- Rule 7(f) — the operator of a processing facility applies in Form I through the local body for SPCB authorisation. There is no tonnage threshold.
- Rule 39(25) — the local body applies in Form I for authorisation of its processing, treatment or disposal facilities, including sanitary landfills, where the waste exceeds five tonnes per day.
- Rule 39(26) — apply for renewal at least 60 days before the authorisation expires.
- Rule 41(1)(v)–(vii) — the SPCB issues the authorisation in Form II within 60 days, synchronises its validity with the validity of the consents, and can suspend or cancel it after notice.
- Rule 21 — the officer in charge reports an accident at a facility in Form VI.
Who This Applies To
Municipal corporations, municipalities and other local bodies that run their own processing or disposal facilities. City-wide governance duties of the local body (bye-laws, ward enforcement, bulk-generator registration) are covered separately.
State-Level Variations
The SPCB of each state issues the authorisation through its own portal. Because consents to operate are now valid until cancelled (Uniform Consent Guidelines amendments of January 2026), an authorisation synchronised with them may carry no expiry date at all.
Compliance Requirements — What You Actually Have to Do
- Keep the Form II authorisation on file for each facility — material recovery facility or processing plant.
- Enter the expiry date only if one is printed on it. EarthReheal WasteLedger then raises the renewal 60 days ahead; with no date, no renewal task is raised.
- Report any accident at the facility in Form VI.
Penalties & Enforcement
Operating a facility without authorisation contravenes rules made under the Environment (Protection) Act, 1986; the SPCB can direct closure and the NGT regularly reviews local bodies' compliance.
Frequently Asked Questions
Q: Our plant handles under five tonnes a day. Do we still need authorisation? A: Rule 7(f) requires every operator of a processing facility to be authorised, with no threshold; rule 39(25) sets the local body's own application duty above five tonnes a day. Apply for any facility you run.
Q: The authorisation has no expiry date. When do we renew? A: Its validity follows the plant's consent. If no date is printed, there is nothing to renew until the Board changes or cancels it.
