Entirely state-driven. Expect differences in:

  • Whether the state has formally revised its Jail Manual to mirror 2016 Model text (and later MHA amendments — MHA has published amendment packets, including post–Supreme Court directions in W.P. (C) No. 1404 of 2023).
  • Whether the state has enacted a new prisons Act inspired by the 2023 Model Prisons and Correctional Services Act.
  • Inspection bodies (IG Prisons, state human-rights commission, judicial inspection) and how strictly 5′ × 5′ toilet specs are enforced in older colonial-era barracks vs new construction.
  • Overcrowding realities that create implementation gaps even where Manual text is adopted — legal standard vs physical compliance may diverge; document upgrade plans.

Compliance Requirements — What You Actually Have to Do

2. Sanitation standards (where Model Manual / adopted state manual applies). Provide sanitary flush toilets; target 5′ × 5′ footprint; impermeable raised base; rain exclusion and sunlight access as specified; privacy partitions; proper drainage to receptacles; maintain cleanliness frequency required by the Manual/state rules.

3. Cell/barrack provision. Work toward flush toilet provision in each cell/barrack as contemplated by Model Manual para 2.09.15 / state equivalent — prioritise new works and major renovations where legacy stock cannot be retrofitted overnight; record phased compliance.

4. Inspection readiness. Maintain as-built drawings, cleaning schedules, water-supply adequacy notes, and prior inspection remarks for IG Prisons / judicial / NHRC or SHRC visits.

5. Wastewater / solid waste. Connect toilet waste to appropriate septic/STP arrangements per PWD and environmental norms; segregate solid waste under SWM rules if the establishment is a BWG (RULE_SWM_2026).

Catalog framing: falling short of prescribed sanitation standards risks adverse findings in prison inspections and administrative action under the state Jail Manual. Exposure is typically departmental (adverse IG remarks, court-monitored compliance orders in PIL/suo motu prison matters, human-rights commission directions), not a central "Model Manual fine schedule." Contempt or court-supervised compliance can follow where High Courts/Supreme Court have issued prison-condition orders for that state.
