Section 7 — Registration of establishments (CLC / Indian Kanoon text): Every employer shall apply to the registering officer —

  • for other establishments, within sixty days from the date the Act becomes applicable —

for registration of the establishment. Late applications may be entertained for sufficient cause. Changes in ownership/management/prescribed particulars must be intimated within thirty days.

Section 46 — Notice of commencement: An employer shall, at least thirty days before commencement of any building or other construction work, send written notice to the Inspector having jurisdiction, covering site location, undertaker, communication address, nature of work and plant, explosives storage (if any), likely worker numbers by stage, person in overall charge, approximate duration, and other prescribed matters. Changes to particulars must be intimated within two days. Emergent works notified by the appropriate Government may be exempt from the 30-day advance notice.

Section 12 — Beneficiaries: Every building worker who has completed eighteen years of age but has not completed sixty years, and who has been engaged in building or other construction work for not less than ninety days during the preceding twelve months, shall be eligible for registration as a beneficiary. (Section 14 addresses cessation — including attaining age sixty or not being engaged for not less than ninety days in a year.)

Section 48 — Penalty for failure to give Section 46 notice: imprisonment up to three months, or fine up to two thousand rupees, or both (Act text as published by CLC / Assam Labour mirror).

B. Building and Other Construction Workers' Welfare Cess Act, 1996

Section 3(1): Cess shall be levied and collected at such rate not exceeding two per cent. but not less than one per cent. of the cost of construction incurred by an employer, as the Central Government may by notification specify.
