SWM Rules 2026 guide

What the SWM Rules 2026 require of hotels, resorts and serviced apartments

Yes, the Solid Waste Management Rules, 2026 (in force from 1 April 2026) apply to hotels, resorts and serviced apartments. Every waste generator must segregate into four streams at source: wet, dry, sanitary and special care.

Rule 5(2) names hotels outright, so its separate-collection, handover and on-site wet-waste duties apply whatever your size. Hotels are a listed commercial category. The three tests therefore apply to you.

At a glance

Every generator · Rule 5(1)

Four-stream segregation, sanitary waste wrapped securely, no burning, dumping or burying, and user fees.

Named in Rule 5(2)

Separate collection, handover of recyclables to authorised agencies and on-site processing of wet waste as far as possible, within one year of notification and in partnership with the local body.

Bulk waste generator · any one test

20,000 sq.m. of floor area, 40,000 litres of water a day, or 100 kg of solid waste a day. Then registration, EBWGR certificates and the 30 June return apply.

What is different for hotels, resorts and serviced apartments

  • Hotels are named in Rule 5(2), whatever their size. A 20-room hotel has the same separate-collection and handover duties as a large one.
  • A hotel becomes a bulk waste generator if it meets any one of the three tests. Measure all three, because a hotel can meet the water or waste test without meeting the floor-area test.
  • Wet waste from kitchens is the largest stream for most hotels. Bulk waste generators must process it on site or, if an existing generator holds an exemption, buy EBWGR certificates for it.

If a hotel is a bulk waste generator

  1. Register on the CPCB portal

Registration is with your local body through the centralised portal at swm.cpcb.gov.in (Rules 6(a) and 16).

  2. Process wet waste, or hold an exemption

New bulk waste generators must process all their wet waste. Existing ones that cannot may take an exemption from the local body.

  3. Buy EBWGR certificates

Certificates cover the dry, sanitary and special care waste you hand over, and wet waste you do not process on site. Only the local body issues them, in kilograms, valid three years.

  4. Use only registered partners

Do not engage any collector, transporter, recycler or processor that lacks the registration the rules require (Rule 6(g)).

  5. File the annual return by 30 June

Filed on the same portal every year (Rules 6(h) and 20(1)).

What the rules do not cover

Bio-medical, hazardous, e-waste, battery, construction and demolition and industrial waste are outside the SWM Rules, 2026 and have their own rules.

The SWM Rules are one part of what applies to hotels, resorts and serviced apartments. Fire safety, electrical safety, water and sewage consents, licences and data protection come from other rules and other authorities.

Frequently asked questions

Does the SWM Rules 2026 apply to hotels, resorts and serviced apartments?

Yes. The Solid Waste Management Rules, 2026 (in force from 1 April 2026) apply to every waste generator, so the Rule 5(1) duties apply to hotels, resorts and serviced apartments: segregate into four streams (wet, dry, sanitary and special care), wrap sanitary waste securely, never burn or dump waste, and pay user fees. Rule 5(2) names hotels outright, so its separate-collection, handover and on-site wet-waste duties apply whatever your size. Hotels are a listed commercial category. The three tests therefore apply to you.

Is a hotel a bulk waste generator?

Hotels are a listed commercial category. The three tests therefore apply to you. A listed organisation is a bulk waste generator if it meets any one of three tests: a floor area of 20,000 sq.m., water use of 40,000 litres a day or 100 kg of solid waste a day. If it is one, it registers on the CPCB portal, buys EBWGR certificates, uses only registered partners and files an annual return by 30 June.

Do small hotels and guest houses have to do anything under the SWM Rules 2026?

Yes. Every generator has the Rule 5(1) duties, and Rule 5(2) names hotels without a size limit, so a small hotel must arrange separate collection, hand recyclables to authorised agencies and process wet waste on site as far as possible. Registration on the CPCB portal, EBWGR and the annual return apply only if the hotel meets one of the three bulk waste generator tests.

What is not covered by the SWM Rules 2026?

Bio-medical, hazardous, e-waste, battery, construction and demolition and industrial waste are outside these rules and have their own.

How can hotels, resorts and serviced apartments check which other rules apply?

EarthReheal’s free compliance check takes about five minutes and shows you the waste rules and the other licensing and regulatory obligations that apply to your type. You see your gaps without signing up. It is a starting point, not legal advice or a certificate of compliance.
